13. YOUR RIGHTS AS A DATA SUBJECT

All information about your rights is available on the website of the Swedish Data Protection Authority:

https://www.imy.se/privatperson/dataskydd/dina-rattigheter/

Your rights are summarised below

Right of access

We Clean Green is always open and transparent about how we process personal data. If you would like to know more about which personal data we process about you, feel free to contact us to gain access to your data. The information is provided in the form of a data extract describing the purpose, categories of personal data, retention periods and information about where the data was collected from.

Right to rectification

You can request that your personal data be corrected if the data is clearly inaccurate. As part of this, you also have the right to complete incomplete personal data.

Right to erasure

You can request the erasure of personal data we process about you if:

  • The data is no longer necessary for the purposes for which it was collected or processed.
  • You object to your personal data being used for direct marketing purposes.
  • The personal data is being processed unlawfully.

Right to restriction

You have the right to request that our processing of your personal data be restricted. A restriction can be requested for several reasons.

  • If you dispute the accuracy of the personal data we process, you can request restricted processing during the time we work to verify whether the personal data is correct.
  • If you object to us erasing your data. This may, for example, be because you need the data we hold about you to establish, exercise or defend legal claims. In these cases, you can request restricted processing of the data with us.
  • If you have objected to a legitimate-interest balancing test that we have carried out as the legal basis for a purpose. In that case, you can request restricted processing during the time we work to establish whether our legitimate interests outweigh your interests in having the data erased.
If processing has been restricted under any of the situations above, we may, apart from storage itself, only process the data to establish, exercise or defend legal claims, to protect the rights of another person, or where you have given your consent.

Right to object to certain types of processing

You always have the right to decline direct marketing and to object to any processing of personal data based on a legitimate-interest assessment. An objection can be made on two grounds:

  • Legitimate interest: where we use a legitimate-interest balancing test as the legal basis for a purpose, you have the possibility to object to the processing. To continue processing your personal data after such an objection, we need to be able to demonstrate a compelling legitimate reason for the processing in question that outweighs your interests, rights or freedoms. Otherwise, we may only process the data to establish, exercise or defend legal claims.
  • Direct marketing: you have the possibility to object to your personal data being processed for direct marketing. The objection also covers the analysis of personal data (so-called profiling) carried out for direct marketing purposes. Direct marketing refers to all types of outreach marketing measures, for example by post, email and SMS
If you object to direct marketing, we will stop processing your personal data for that purpose and cease all types of direct marketing.

14. HOW IS YOUR PERSONAL DATA PROTECTED?

We Clean Green uses IT systems to protect the confidentiality, integrity and availability of your personal data. We have implemented specific security measures to protect your personal data against unlawful or unauthorised processing (such as unlawful access, loss, destruction or damage). Only those individuals who genuinely need to process your personal data in order for us to fulfil our stated purposes have access to it.

15. THE SWEDISH DATA PROTECTION AUTHORITY IS THE SUPERVISORY AUTHORITY

The Swedish Data Protection Authority (Datainspektionen) is responsible for monitoring compliance with the legislation. Anyone who believes a company is handling personal data incorrectly can file a complaint with the Swedish Data Protection Authority.

If a personal data incident occurs, we are obliged to report it to the Swedish Data Protection Authority. An incident is an event that leads to accidental or unlawful destruction, loss or alteration of your personal data.

It may also be considered a personal data incident if the event leads to unauthorised disclosure of, or unauthorised access to, the personal data processed. The incident must be reported to the Swedish Data Protection Authority within 72 hours of its discovery.
